General Terms and Conditions for Guests
1. Validity of General Terms and Conditions (AGB)
Unless otherwise agreed, the General Terms and Conditions notified to our contract partner apply.
Our contract partner agrees that if General Terms and Conditions are used by him, our conditions apply in case of doubt, even if the contract partner’s conditions have not been objected.
Insofar, fulfilment activities performed by us are not to be considered as a consent to contract conditions differing from our conditions. Any eventual ambiguities in relation to the contract interpretation are to be eliminated in a way that such contents that is usually agreed in similar cases is deemed as agreed.
These General Terms and Conditions are an integral part of all our correspondence. They will be part of the brokerage contract between Cityflats4you (hereinafter “the broker”) and the accommodation prospect (hereinafter “the guest”), as well as the accommodation offerer (hereinafter “the host”):
a) Cityflats4you OG acts as a broker for short-term lease contracts for rooms, apartments, houses and bungalows nationally and internationally for tourism purposes only.
b) Please be aware that the main contract (lease contract) is closed between the host and the guest. The broker acts as an agent only. The broker also assumes no liability for the place, equipment and other elements of the mediated lease objects. All claims arising from the lease contract or in connection with any indemnification or loss of trust can only be asserted against the host.
c) The broker is not a tour organiser but rather an IT service provider. Therefore the tourism law and/or related legal aspects do not apply.
The commission obligation comes into effect upon sending the reservation confirmation to the guest and shall remain effective even if such agreement is revoked.
Attention
The brokerage commission is only due in case of a successful booking.
2. Contract and contract term
a) The contract partners agree that the present General Terms and Conditions become part of each brokerage contract coming into effect via the Cityflats4you.com homepage. Any modification shall only be valid in writing.
b) The object involved in the transaction is leased for a limited period and solely serves for tourism purposes. The transaction is based on the lease contract, which comes into effect by sending the reservation confirmation to the guest and which is accepted as the underlying basis by both parties with the completion of the booking transaction.
3. Payment terms
The prices indicated by us are gross lease prices that include a commission of 9.1% as well as the net lease for the object. The commission is settled and collected via credit card. The remaining lease for the complete lease period is payable in advance and upon arrival on site to the host by the latest, unless otherwise expressly agreed with the host.
4. Hand-over of keys and accommodation unit
The key is handed over on-site upon acceptance of the accommodation unit from the host. The host is responsible for providing the booked services. The host’s name and address is included in the booking documents.
5. Number of persons
Please indicate the correct number of persons (children are considered as full persons) when booking. In case of wrong indications for the accommodation unit, the host is entitled to refuse handing over the accommodation unit. Persons in excess of the indicated number must leave the object immediately unless otherwise agreed with the host.
6. Data protection
The broker only collects and uses guest’s personal information to the extent required for performing his brokerage activities. The information is transmitted to the corresponding host only in case of a successful booking transaction and is hereby expressly agreed by the guest. No information is disclosed to third parties.
The guest agrees to receive information via email from Cityflats4you.com from time to time. If the guest wishes to unsubscribe this service, he/she must notify his/her intention in writing via the contact form on the homepage mentioned above.
7. Applicable law
The Austrian law applies. The legal venue for any disputes arising from the brokerage agreement is the competent court for the registered office of our company. The legal venue is Vienna, regardless of your citizenship and your place of residence. However, we are also entitled to file a claim at the contract partner’s general legal venue.
8. Guest’s obligation to truth
The guest confirms that the personal information provided by the latter is completely true and correct. The provision of incorrect information is prosecuted according to the applicable legal regulations and the originator is held liable for any damages resulting thereof.
9. Final provision
The present contract supersedes any oral subsidiary agreements. Modifications and amendments shall only be valid in writing. If any clause of the present contract should be or become invalid, the remaining clauses herein remain in full force and effect. The parties hereto agree to replace the invalid clause with a valid clause that resembles to the effect the parties had intended if they had considered this point to the extent permitted by law. This provision shall apply accordingly to any gaps in the contract.
